The main idea here is what counts as construction activity under the Construction General Permit (CGP). The CGP covers stormwater discharges from construction activities that disturb soil, including building new facilities or adding new impervious surfaces. However, routine maintenance that preserves the original line and grade, hydraulic capacity, or original purpose of a facility is not considered construction activity and is not covered by the CGP.

So, activities like paving new surfaces adjacent to the facility, installing new outfalls, and constructing a new facility all involve new construction or changes to the site and are covered by the CGP. Routine maintenance, by contrast, does not initiate new disturbance beyond what already exists, so it falls outside CGP coverage.
